Having alcohol in the persons system almost always (if not always) makes them at fault in any traffic accident. They persons credibility is out the window, so the other driver could argue they stopped abruptly/suddenly, or turned into that lane suddenly, and the drunk person has no case.I guess the only way it wouldn't be his fault is if the other driver admitted fault, but even in that case, the judge/insurance company might argue other wise.
